seems legit, downloaded about 100MB already
Transfer rate is between 17KB/s and 33KB/s so far... not too shabby

Yeah I already thought of that. Key part is 'depends on local legislation'. Turns out 'importing' music isn't illegal for personal use. Now if you want to redistribute the tracks you get, then you are fucked.

it seems to me that their argument for why this is legal is because you're technically importing... But I don't believe this to legally be the case (though with my minimal amount of legal knowledge I think the line is a little fuzzy).

If you buy something online from your computer in NY from a company in DE, the United States says you need to pay NY sales tax on it... even though the product has to then be shipped from DE, which is a tax free state. So the United States doesn't believe ordering online in NY from a company in DE is technically importing a product from DE, they consider it to be buying a product in NY. If we follow this logic, the United States would therefore consider your purchase of a song from AllOfMP3 to be a purchase made inside the United States and therefore not an import.

Similarly, iTunes charges you sales tax based on your bill-to address at the time of purchase, because the point of sale is considered to be YOU, not their database or company offices in CA. The laws applying to the purchase are the laws where you are, not the laws where the company is, you're not importing music to wherever you are from Apple, you're buying it straight up wherever you are.

If it's not an import, is it still legal? I've seen nothing to argue this point. I've only seen arguments that you're importing music which was purchased in Russia, which I've already suggested is not how I believe the United States Government would view your purchase.

I doubt there's going to be some sort of massive crackdown on this anytime soon , but I still can't rationalize any way that this would be considered legal with what I know of United States policy. It's a lot closer to the fuzzy line than straight p2p file sharing... and your giving the bare minimum amount of money which I suppose is good for your self-realized karma... but despite what two webpages say this isn't clearly legal.

and if you're so desperate to get around the system by doing something which is questionable at best, then I question why you bother paying at all.

Musicians playing in the NYC subways can and will make significantly more than 3 cents per song (my friend was earning about a quarter a song, thats more than 8x what you feel like paying). What kind of market force are you going for, that musicians shouldn't bother coming out of the subway?
